Terms of Service

The agreement that governs access to and use of Wayfound's website, applications, and services.

These Terms of Service ("Terms") are a binding agreement between you and Wayfound US, Inc. ("Wayfound," "we," "us," or "our") and govern your access to and use of the Wayfound website, applications, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Please read Section 2 and Section 3 carefully. Wayfound is an informational and organizational tool. It is not a law firm, advocacy organization, medical provider, or government agency, and the information it provides, including content generated with the help of artificial intelligence, is not professional advice. You are responsible for your own decisions, and you should confirm important information with the relevant agency or a qualified professional.

1. Who we are and acceptance

Wayfound US, Inc. is a Delaware corporation. The Service helps families raising children with disabilities find programs they may qualify for, understand documents and notices, prepare forms and letters, and track deadlines, primarily in California and Texas. By using the Service you confirm that you have read, understood, and agree to be bound by these Terms.

2. What Wayfound is, and what it is not

Wayfound provides general information, document analysis, suggested next steps, draft letters and forms, and organizational tools to help you navigate disability-related programs and services. Wayfound provides this only as an informational aid:

  • Wayfound is not a law firm and does not provide legal advice or legal representation.
  • Wayfound is not a medical, psychological, or healthcare provider and does not provide medical advice, diagnosis, or treatment.
  • Wayfound is not a tax, financial, accounting, or immigration advisor and does not provide advice in those areas.
  • Wayfound is not a government agency, regional center, school district, or benefits program, and is not affiliated with or endorsed by any of them.
  • Using the Service does not create an attorney-client, advocate-client, or provider-patient relationship.

Information from the Service is a starting point to help you ask better questions and act with more confidence. Eligibility rules, program details, deadlines, phone numbers, and legal citations change and vary by county and circumstance. You should always confirm important details with the relevant agency, program, or a qualified professional before you rely on them.

3. AI-generated content

Parts of the Service use artificial intelligence to analyze the documents and information you provide and to generate summaries, suggestions, draft letters, and answers. AI-generated content can be inaccurate, incomplete, or out of date, and may not fit your specific situation. We do not guarantee the accuracy, completeness, timeliness, or suitability of any AI-generated content.

You agree to review AI-generated content critically and to verify anything you intend to rely on, especially deadlines, eligibility determinations, legal references, dollar amounts, and any step that could affect your child's services, benefits, or legal rights. Do not rely solely on the Service for decisions that carry legal, financial, medical, or immigration consequences.

4. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for parents, guardians, and caregivers acting on behalf of a child or family member. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.

5. Plans, pricing, and billing

Wayfound offers a free plan and a paid plan ("Premium").

  • Free plan: browse programs, view a personalized eligibility report, view deadlines, and limited use of the Navigator chat. No charge.
  • Premium: 19 US dollars per month, or 190 US dollars per year. Each additional child beyond the first is 3 US dollars per month, or 30 US dollars per year. Premium includes the full set of features, including document analysis, forms and letters, and unlimited Navigator chat.
  • Free trial: new families may receive a 14-day trial of Premium features that does not require a credit card. At the end of the trial your account moves to the free plan automatically. We do not charge you when the trial ends, and you are not enrolled in a paid subscription unless you choose to subscribe.

Prices are in US dollars and exclusive of any applicable taxes, which you are responsible for. We may change our prices on a going-forward basis, and we will give you advance notice of any price change that would affect your subscription before it takes effect.

6. Automatic renewal, consent, and cancellation

Premium subscriptions renew automatically. When you start a paid Premium subscription, it continues and renews automatically at the end of each billing period (monthly or annual) at the then-current price, using your payment method on file, until you cancel. There is no charge for the free plan or for the no-card trial.

Before you start a paid subscription, we disclose the subscription price, the billing frequency, the renewal terms, and how to cancel, and we obtain your affirmative agreement to those terms at checkout. You authorize us and our payment processor to charge your payment method for the subscription and any applicable taxes on each renewal until you cancel.

How to cancel. You can cancel at any time from your account settings, using the same online method you used to subscribe. Cancellation stops future renewals. When you cancel, your Premium access continues until the end of the period you have already paid for, and then your account moves to the free plan.

Renewal reminders. Where required, we will send you reminders about your subscription and its renewal, along with information about how to cancel.

Refunds. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods. Because new families can use Premium features free for 14 days before paying, you can evaluate the Service before any charge.

7. Acceptable use

You agree not to: use the Service for any unlawful purpose; upload or submit information about another person without the authority to do so; misrepresent your identity or your relationship to a child whose information you provide; attempt to access accounts or data that are not yours; copy, scrape, resell, or commercially exploit the Service or its content except as expressly permitted; reverse engineer or attempt to extract the underlying models, knowledge base, or source code; introduce malware or interfere with the Service; or use the Service in a way that could harm Wayfound, other users, or any third party.

8. Your content and documents

You retain ownership of the documents and information you upload or provide ("Your Content"). You grant Wayfound a limited, non-exclusive license to host, process, and use Your Content solely to operate and provide the Service to you, including to generate analysis, suggestions, and drafts for you. You represent that you have the right to provide Your Content, including any information about your child or family member, and that doing so does not violate the rights of any third party or any law.

We do not sell Your Content. We do not use Your Content to train third-party foundation models, and our AI processing is configured so that your data is not retained by our AI provider to train its models. See our Privacy Policy for details on how we handle your information.

9. Intellectual property

The Service, including its software, design, text, knowledge base, and the Wayfound name and logo, is owned by Wayfound or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the Service for your family's own non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

10. Third-party services

The Service may reference or link to government agencies, programs, providers, and other third parties, and relies on third-party services such as our payment processor. We do not control and are not responsible for third-party content, services, decisions, or practices. Your dealings with any third party are solely between you and that third party.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information, including AI-generated content, eligibility results, or deadlines, is accurate, complete, current, or applicable to your situation. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Wayfound and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of benefits, services, profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, Wayfound's total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid Wayfound in the 12 months before the event giving rise to the claim, or 100 US dollars. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Wayfound and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your misuse of the Service, your violation of these Terms, your violation of any law, or Your Content.

14. Dispute resolution

Informal resolution first. If you have a concern, please contact us at hello@wayfound.us so we can try to resolve it. Most concerns can be resolved this way.

Arbitration and class-action waiver. If a dispute cannot be resolved informally, you and Wayfound agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider, rather than in court, except that either party may bring a claim in small claims court. You and Wayfound waive the right to a jury trial and agree that disputes will be brought only in an individual capacity and not as part of a class or representative action. You may opt out of this arbitration agreement by notifying us in writing at the contact address below within 30 days of first accepting these Terms.

Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms with a new date or by notifying you in the Service or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.

16. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends. Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Wayfound regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control. Notices to you may be provided in the Service or by email; notices to us should be sent to the contact below.
